Terms of Service
Welcome to ListProof (“the Service”, “we”). By creating an account or using the Service, you accept these Terms. If you don't agree, don't use the Service.
1. What the Service does
ListProof is a pre-send email hygiene tool. You upload a CSV (usually exported from Apollo) or fetch leads via your own Apollo API key, and the Service classifies each email address into three buckets — SAFE, VERIFY or REMOVE — to reduce bounces when importing into platforms like Instantly or Smartlead. The Service does not send emails and does not guarantee deliverability; it reduces risk, it does not eliminate it.
2. Account & subscription
You need an account (email + password) to use the Service beyond the public pages. Access to processing features requires an active monthly subscription billed via Stripe at 29 €/mo (taxes may apply), or available pay-per-use credits. Your subscription renews automatically until cancelled via the customer portal.
You can cancel anytime. Cancellation stops future renewals; the current billing period stays active until its end date. We don't refund unused time on a paid period unless required by law.
3. Your API keys (BYOK)
The Service runs on a Bring-Your-Own-Key (BYOK) model for third-party providers such as Apollo and ZeroBounce. You are responsible for obtaining those keys, complying with their terms, and any usage fees they charge. Your keys are stored in your browser (localStorage) by default — we don't keep them on our servers and never share them with anyone other than the provider you're calling.
4. Your data
You retain all rights to the CSV files and lead data you process. Uploaded CSVs are processed in memory for the duration of the request and are not written to our database. The only data we keep about you is: your email address, subscription status, credit balance, and the billing metadata required by Stripe.
5. Acceptable use
You agree not to:
- Use the Service to validate emails you have no legitimate reason to contact;
- Use the Service for spam, phishing, unauthorized scraping or any illegal activity;
- Reverse-engineer, resell or bulk-extract the Service;
- Bypass the subscription paywall, authentication or rate limits.
6. Disclaimer of warranties
The Service is provided “as is” without warranty of any kind. Email classification relies on heuristics and third-party validation providers and will never be 100% accurate. Use the Service as one part of your deliverability workflow, not as a final authority.
7. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
8. Governing law
These Terms are governed by French law. Any dispute will be submitted to the exclusive jurisdiction of the competent courts of Paris, France, unless mandatory consumer-protection laws of your country of residence provide otherwise.
